Malcolm-Jamal Warner's Widow Is Suing His Mother Over a Prenup Signed Eight Days Before the Wedding

The widow of Malcolm-Jamal Warner is suing his family trust and its trustee, the actor’s mother, to enforce a prenuptial agreement he signed eight days before their wedding.

Dr. Tenisha Warner filed against the Warner Family Trust and Pamela Warner in Superior Court in Decatur, Georgia, case number 26CV6673. She is seeking roughly $1.2 million and an injunction stopping distributions from the trust while the case proceeds.

What the Agreement Promised

The prenuptial agreement was signed on May 15, 2022. The couple married on May 23, eight days later.

According to the complaint, it committed Warner to several ongoing financial obligations: a $1 million life insurance policy, annual anniversary payments, yearly contributions to a Roth IRA, and a monthly payment for his wife’s role as his chief of staff.

The suit alleges those obligations went unmet. It says the life insurance policy was never established.

Why a Prenup Outlives the Marriage

Warner, who played Theo Huxtable on The Cosby Show, died on July 20, 2025.

Sean Weissbart, an estate attorney quoted by Forbes, described the legal mechanism at work: “Now he dies; it makes the surviving wife a creditor.”

That is the argument in one sentence. A prenuptial agreement is a contract. If it created obligations that were never fulfilled, the surviving spouse is not asking for an inheritance. She is presenting a bill.

Pamela Warner has not responded publicly, and no filing on her behalf has been reported.

What Comes Next
