
If You Have Medicaid and a Chronic Illness, a New Federal Rule Just Made It Harder to Keep Your Exemption.

A federal rule that took effect Thursday narrows who qualifies as “medically frail” under Medicaid’s work requirements - and could strip the exemption from millions of adults with chronic illnesses, disabilities, and serious medical conditions who would have qualified under the law Congress passed.
The Centers for Medicare and Medicaid Services published the Interim Final Rule on June 3, 2026. It takes effect July 31. The rule implements Medicaid work requirements enacted in H.R. 1, but adds a qualification Congress did not include: to be considered medically frail, it is no longer enough to have a serious or complex medical condition. The condition must also “significantly impair” your ability to perform the required 80 hours per month of work, school, or community service.
What Changed - and What Congress Actually Said
H.R. 1 defined “medically frail” to include five categories: people who are blind or disabled; people with a physical, intellectual, or developmental disability limiting activities of daily living; people with a substance use disorder; people with a disabling mental disorder; and people with a serious or complex medical condition. None of those five categories, as written in the statute, required proof that the condition impairs ability to work.
CMS’s rule added that impairment test. A person with cancer, heart disease, lupus, or severe diabetes may fall into the “serious or complex medical condition” category - but under the new rule, they must also demonstrate that the condition significantly impairs their ability to comply with the work requirement. Health policy researchers at Georgetown University’s Center for Children and Families described this as CMS imposing a standard “Congress did not enact.”
Who Is at Risk and What They Need to Do
The work requirements take effect January 1, 2027. States must notify affected enrollees by August 31, 2026 - in five weeks. People who currently hold a medically frail exemption may receive a notice requiring them to document that their condition meets the new standard. States are responsible for assessing exemption eligibility, and many are still building the systems to do it.
For Medicaid enrollees with a chronic condition, the practical advice is: contact your state Medicaid office now. Ask whether your exemption is still valid under the new IFR standard. If your doctor has documentation of how your condition affects your daily functioning, secure that documentation before August 31.
