Sean Combs' Federal Appeal Was the First of Its Kind. The Second Circuit Ruled. His Release Date Just Moved.

Two things changed in Sean Combs’ case this week. The Second Circuit Court of Appeals issued its ruling on his sentencing appeal - a case the panel itself called an “exceptionally difficult” question no federal court had previously answered. And federal records now show his projected release date has moved to January 24, 2028, roughly a month earlier than previously scheduled.

The Question the Appeal Was Built Around

Combs was convicted in July 2025 on two Mann Act counts and acquitted of the more serious charges - racketeering and sex trafficking. Judge Arun Subramanian sentenced him to 50 months. His appeal argued the sentence was calculated using conduct the jury explicitly rejected, in violation of 2024 U.S. Sentencing Commission guidelines that restricted the practice of factoring in acquitted conduct.

At oral arguments in April, Circuit Judge William Nardini pressed prosecutors directly: “What your argument would lead to is that there’s no such thing as acquitted conduct. Tell me why I’m wrong about that.” All three judges questioned both sides for nearly two hours. The panel called the question one of first impression - not only for this court but for any federal appeals court in the country.

What the Records Now Show

ABC News reviewed federal inmate records on July 30 showing Combs’ projected release had moved to January 24, 2028 - approximately one month earlier than previously reflected. The Federal Bureau of Prisons did not explain the change. Release dates shift based on behavior credits and program participation.

ABC News also reported that Combs was placed in solitary confinement after an altercation in which another inmate made a remark. His representative did not comment on the reported incident.

The Stakes Beyond His Sentence

The Second Circuit’s ruling matters beyond Combs. If the panel found the judge used acquitted conduct improperly, the decision sets the first federal appellate precedent on the post-2024 sentencing guidelines - directly affecting how every federal judge in the circuit sentences defendants going forward. His civil lawsuits remain active in multiple jurisdictions regardless of the criminal appeal’s outcome.
