IRS Sending Automatic Adoption Credit Refunds to 50000 Taxpayers
Daniel Reeves
Updated Oct 27, 2026
The IRS says it has begun issuing automatic refunds to more than 50,000 taxpayers whose unused adoption tax credits from earlier years may now count toward the refundable portion of their 2025 credit. The agency says most eligible families will not need to file an amended return, and it expects to finish most qualifying adjustments by the end of 2026.
The potential payment comes from a narrow change in how the IRS treats the refundable portion of the adoption credit for tax year 2025. The change applies to qualifying 2025 returns with adoption-credit carryforwards from earlier years.
The older credits that suddenly matter
Families sometimes qualify for an adoption tax credit larger than the amount they can use against their income tax liability in a single year. Under certain rules, unused amounts may be carried forward to later years.
The Treasury Department has clarified how the 2025 refundable credit interacts with carryforwards from tax years 2020 through 2024. According to the IRS, those older amounts can now increase the refundable adoption credit on a 2025 return, subject to a limit of $5,000 per qualifying child.
That specific treatment applies to tax year 2025. Families should not assume that every prior-year credit becomes refundable or that the entire balance of a carried-forward credit will be paid out as cash.
Why many taxpayers need do nothing
The IRS says it began adjustments in late September. For qualifying 2025 returns filed before April 15, 2026, the agency generally expects to make the adjustment and issue any resulting refund automatically.
That could save families the time and cost of preparing an amended return. It also means the agency can use information already reported by the taxpayer to determine whether the new interpretation changes the amount owed or refundable.
The IRS plans to send a notice generally within 30 days of an adjustment. The notice should explain the change and whether the amount resulted in a refund or was applied to an existing federal or other eligible debt.
Which cases may take longer
People who filed extensions, have returns not yet processed or have identity-theft flags, account freezes or dependency conflicts may need to wait while the agency addresses those issues. A delay in that situation does not necessarily mean the family was found ineligible.
The IRS advises recipients to compare the notice with their 2025 tax return and keep it with their tax records. Its online account can also show tax records, notices and refund status.
What families should check
The important question is whether the family claimed the adoption credit and carried an unused portion from the covered years into 2025. Not every adoption creates an eligible carryforward, and household circumstances affect the result.
The IRS says affected taxpayers generally do not need to act to receive the adjustment. Its official Adoption Credit page provides the rules; the new notice will supply the specific dollar amount for each account once processed.
